Many years ago, I wrote the rail security provisions in the Implementing Recommendations of the 9/11 Commission Act. These provisions will now be scrutinized by federal judges in California.
Yesterday, Union Pacific and the BNSF Railway went to court to stop the state of California from imposing new safety requirements on the railroad carriers. Their argument, as reported in the Fresno Bee, is that the federal government is responsible for creating these standards.
Pursuant to the 9/11 Act, the federal government (Department of Homeland Security) is supposed to be working with state and local officials to review the rail carrier’s security plans.
As I told the Fresno Bee, these plans should be shared with local officials and the neighbors. It will be interesting to see what the federal judges have to say.
